Counsel

Details: Protect Mack Trucks’ and Volvo Trucks’ corporate assets, business reputation and other interests pertinent to its various corporate activities. CORE RESPONSIBILITIES:•         Render legal advice in person to support business and management strategy.•         Interact with corporation and third-party business and legal personnel on relevant legal matters.•         Assume functional legal leadership for Mack Trucks and/or Volvo Trucks in the legal disciplines of:o    Insurance and non-insurance product liability, warranty and related product litigation;o    Federal recall and related product campaigns (regulatory and compliance);o    Asbestos litigation defense;•         Institute or defend against claims, demands or litigation and the management of lawsuits.•         Function both independently and as part of a team to deliver quality work product in a timely fashion while maintaining the confidentiality of Legal department communications and documentations.•         Coordinate matters in concert with other members of the Legal department related to litigation to initiate legal action or formulate defenses against other persons or entities.•         Ensure that appropriate contracts are in place (by drafting, reviewing and revising agreements) that define the parties’ responsibilities and identify and reasonably allocate risks.•         Educate, advise, and counsel business colleagues on relevant legal issues.•         Responsible for handling requests from internal clients and supporting Senior Attorneys in the department as required in legal disciplines of:o    U.S. distributor, franchising and vehicle product sales and distribution;o    International franchising and vehicle product sales and distribution;o    Real estate transactions, including negotiations and transactional underwriting;o    Environmental, superfund and related disposal claims, case management and litigation;o    Antitrust claims, litigation and legal advice;o    Record retention policy and guidelines;o    Bankruptcy litigation oversight and committee participation;o    E-Commerce computer and information systems privacy law;o    Purchasing, joint development and supply agreements; ando    Other legal disciplines as required.•         Manage special projects and perform other related duties as assigned.  COMPETENCIES:•         Well versed in the current laws and regulations to accurately support the customer base in various legal disciplines.•         Strong verbal and written communication skills, as well a positive professional image.•         Ability to work with colleagues, business partners and potential adversaries from other countries and cultures.•         Must be exceptionally organized and prepared to work under pressure in a fast-paced environment.•         Strong negotiation skills.•         Ability to work in a strong team environment.•         Adept at computerized legal research, and in working with various IT applications.MINIMUM EDUCATION AND EXPERIENCE: •         Juris Doctorate Degree from an accredited law school required.•         Must be licensed to practice law.•         Minimum of 3 years experience.•         Products liability, asbestos or other similar litigation experience.•         Strong business background or experience preferred. DisclaimerThe above statements are intended to describe the general level of work being performed by persons assigned to the classification.
